Further to our telephone conversation regarding Malcolm's legal status under the Mental Health (Compulsory Assessment and Treatment Act) 1992, I wish to confirm that he is subject to a deemed Community Treatment Order persuant to Section 144 of the Act.

The CTO took effect from 1 November 1992 and expires on 1 May 1993.

Persuant to Section 76 of the Act Malcolm was due for a clinical review by 1 February 1993. However, we have been unable to complete all reviews required by the transition arrangements from the Mental Health Act 1969 to the new Act. This is the situation across the country.

I have requested the Responsible Clinician, Dr Jim Short reappoint Malcolm with a view to clinically reviewing him this week. I trust this will elucidate the matter.
