Okay thanks, that sounds good.
My letter to the PM ended in the hands of Chester Borrows, who replied but was confused about why I was in court. Unfortunately he is no longer the minister. I wrote to Amy Adams, Minister of  Information Technology (new minister of Justice) about my software, but she is hopeless and clueless even when the situation is explained clearly to her.
Let me know when to come over and I'll sign those papers.

Greetings Malcolm -

Please see below the email I received from Detective Senior Sergeant Greg Turner of Tauranga Police and my reply. Unfortunately it seems the Police are not willing to make a payment of their own volition. So, I will now need to advance the costs application proceedings. I will draft an affidavit for you to swear supporting the application, and will also draft a memorandum of submissions for the Court setting out why I believe the Court should make an order for costs against the Police, I’ll get in touch with you as soon as I have the paperwork ready, and then we can ask the Court to set a hearing date.

Kind regards,

Greetings Greg -

That’s correct.

With respect, I do not agree with the Police Legal Section view.

I will advise Mr Baker and prepare the necessary further documentation to advance the costs application. Regrettably I will now need to seek costs for my involvement on Mr Baker’s behalf. Had we been able to settle the matter without need of a full hearing then I would have been prepared to forego a claim for my costs simply to put matters right for Mr Baker. However, I have spent a significant amount of time on the matter already for him and it seems more time will now be required.

Are you able to indicate what action the Police are taking with respect to Mr Baker’s complaint of assault and wilful damage to his car, arising from the same matters to which the costs application relates?

Thanks for your attention to the matter.

Kind regards,

David Bates

It does not look like the matter will be settled by payment of costs as legal section believe there is little merit in your case.

I hold the IPCA complaint for District Complainant resolution and as I understand the position the matter cannot be conciliated in the absence of payment of costs by the Police.

We therefore have an impasse that I cannot see us resolving

Is that position correct ?
