Dear Mr Baker

I am writing on behalf of Hon Michael Woodhouse, Minister of Police, who has asked me to acknowledge and thank you for your email of 8 October 2014 concerning your legal fees . Please be assured that your comments have been noted.

I must point out that politicians cannot instruct Police in operational matters.  This is a long standing convention that was enshrined in law with the passing of the Policing Act 2008.  It ensures that law enforcement and investigation by the Police remain free of any political influence or interference.

I note that you matters are still subject to an Independent Police Conduct Authority investigation and that your lawyer may yet seek a legal remedy. These courses are most appropriate forums to resolve your issues.

Yours sincerely

Subject: Police Complaints

Dear Minister
In 2012 I was charged by the police with two matteers which were later dropped. The complaint made against me was false. I employed a lawyer which my sister paid for, and I also applied for legal aid, and I'm paying off my debt at $10 every two weeks. It is an extreme burden as I don't have an income to cover this. I don't believe Ministers actually know how hard it is to survive on $12,000 pa.
Enclosed ia correspondence my lawyer sent me. Do you think it is just that teh police can charge someone who has been assaulted, and has had property damaged, and then investigate the complaint made against them? The police came to my home after I made a 111 call, but charged me with drunk driving, even though they did not see me driving. They then confiscatedd my license for a month, before dropping the charges on this case also. All the while I'm waiting to find out whether the man who assaulted me was charged. He was a gang member and this is significant.
There is no justice. There is no protection by the police.

The position is not correct, as my lawyer is going to take it to court, and will have to undertake this case at his own expense. He knows the facts, and the law, and used to be a police inspector. I wrote to you saying the government owes me money for software. You reply appeard to be that I do not own any software and that I am deluded. This is far from correct, I just hope you appreciate that this is not a game.
Yours sincerely
Malcolm James Lorenzo Baker.

Subject: RE: Baker - Costs

It does not look like the matter will be settled by payment of costs as legal section believe there is little merit in your case.

I hold the IPCA complaint for District Complainant resolution and as I understand the position the matter cannot be conciliated in the absence of payment of costs by the Police.

We therefore have an impasse that I cannot see us resolving

Is that position correct ?
